1. The use of  the Westminster Stone website
The Westminster Stone website is provided to you for your personal use, free of charge, and its use is subject to these Terms and Conditions. By using the Westminster Stone website you agree to be bound by these Terms and Conditions.

 

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.

 

2. Amendments to the Terms and Conditions
We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on account registration or via a suitable announcement on the westminsterstone.com website. Any changes will apply to the use of the westminsterstone.com site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the website. If you continue to use the westminsterstone.com site after the date on which the change comes into effect, your use of the westminsterstone.com site indicates your agreement to be bound by the new Terms and Conditions.

 

3. Privacy Policy
At Westminster Stone, we value and protect customer details. The information we collect from you whilst processing your orders on-line will be used in a lawfully and abiding manner in accordance with the Data Protection Act of 1998.

 

The particular types of information we require from you to process orders on-line are your name, address, phone number, email address, and credit or debit card information. We take this information about our customers in order to help process your order in a fast and efficient manner and to help us provide the best possible service from purchase through to delivery.

 

You will have the opportunity to permit us to hold your information for future reference or have your details removed once your transaction has been completed.

 

Additionally, we can provide you with information about products and special offers you may be interested in. You will have the opportunity to refuse the option of receiving any marketing information, promotional product information and specials which we may have on offer.

 

If you would at any time like to see a copy of the details we hold about you please contact us in writing, there maybe a small fee to pay to cover our administration time and you will be advised of this when you contact us.
For delivery purposes only, a third-party company may be used and it may be necessary for us to disclose your full postal address (your delivery name, address and postal code).

 

Where it is not possible for us to supply you directly, your enquiry details will be forwarded to a local reputable stockist of Westminster Stone products. No confidential card details will be forwarded.

 

4. The contract
We must receive payment of the whole of the price for the goods that you order before your order can be processed. Once payment has been received by us we will confirm that we are sure that the goods ordered are available in stock by sending an email to you at the email address you provided upon account registration. We will then despatch the goods to the address provided upon your account registration. In the unlikely event that the goods ordered are not available, or that no alternative product offered is acceptable to you, we shall email you at the email address you provided upon account registration and arrange for your payment to be re-credited to your account within 14 days.

 

5. Delivery of goods to you – Including Delivery Policy
All full packs and all orders containing at least one full pack will be delivered free of charge, or for the subsidised delivery charge applicable to your county. Delivery charges for individual units range from £0 - £75 and are calculated based on the volume and weight of products ordered, and the delivery destination.

 

Orders cannot be accepted for delivery to some counties where Westminster Stone stockists operate; acceptance of these Terms and Conditions authorise us to pass your enquiry to the stockist in your area.

 

Delivery will normally take about 7 days. Westminster Stone will always contact you by email or directly by phone within one working day of your order to arrange a delivery date. If the date provided is unsuitable please contact Westminster Stone Company Limited by email at ask@westminsterstone.com, or phone on 01978 710000. We will endeavour to arrange an appropriate date and time for delivery. You will be sent an email to confirm the specific delivery date.

 

Please note:

  • Working days are classified as Monday to Friday and exclude Bank holidays.
  • Delivery times apply to items in stock.
  • If any items you order are not available we will telephone you to discuss how you wish to proceed. If we are not able to contact you we will refund you accordingly.
  • Timed deliveries are available at additional cost.
  • Next day deliveries (working day) are available at additional cost. In this case the order must be received before 11.00am the previous day, and the goods must be available from stock.


Westminster Stone delivers to all UK mainland addresses. We regret that we are currently unable to deliver to Northern Ireland, Scottish Islands, Isle of Man, Isle of Scilly, Jersey, Guernsey and BFPO addresses through the website, but are able to quote you; simply email or phone us your enquiry, and we will quote you.

Please note that for those customers who live in some remote rural areas, our delivery service may be extended by 2 working days or in exceptional circumstances, we may contact you to advise that your address is not serviceable.

 

Delivery to an address other than your billing address is permitted.

 

Delivery
Deliveries normally occur between 7.30am and 5.30pm. Once your order has been placed you will be contacted and provided with an exact date of delivery.

 

Unless otherwise stated, all deliveries will be made to the kerbside or the bottom of the driveway. Access must be provided for a Class 2 (Rigid) LGV up to 11 metres (36 feet in length) and 2.4 metres (+ mirrors) in width. Smaller vehicles may be available, but may incur additional delivery charge.

 

Our Customer Services team will advise how to prepare for receipt of ordered goods. Our delivery team are not responsible for any additional lifting or carrying of your goods.

 

We do not deliver items to multiple addresses.

 

Preparation for delivery
When contacted by Westminster Stone to arrange delivery please:

  • Confirm address details including the postcode, and leave a daytime telephone number. so that we can contact you if necessary on the day of delivery.
  • Ensure the delivery area is flat and solid enough to take the weight of a pallet truck carrying up to 1.2 tonnes in weight.
  • It is essential to have someone on site to sign for the delivery, but it is also advisable to have someone taking delivery that is able to help the driver if required, as they may occasionally need assist with unloading.
  • Please advise Westminster Stone of any constraints which may restrict access to your address for our delivery vehicles.

 

THIS POLICY DOES NOT AFFECT YOUR STATUTORY RIGHTS

 

Phone lines are open 7.30am – 5.00pm weekdays, 9.00am – 1.00pm Saturday , Closed Sundays.

 

Samples
Samples may be ordered online for a small charge, and the details of credit against orders may be accepted as read. The refund will be made by telephone transaction. It is the responsibility of the customer to arrange such credit with Westminster Stone. Where samples of more than one product is required, it may be financially advantageous to contact the sales office on 01978 710000 to arrange an alternative method of delivery of samples.

 

It should be noted that because of the nature of the products, there is a natural variation in colour and hue of all products, and as such, any sample will be selected as a representative guide.

 

6. Price
6.1 The price payable for goods that you order are as set out in our website.
6.2 You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations.

7. Right for you to cancel your contract
7.1 You may cancel your contract with us for the goods that you order at any time up to the date of dispatch; this will normally be three working days prior to delivery. You do not need to give us any reason for cancelling your contract at this stage, nor will you have to pay any penalty.

 

7.2 Westminster Stone Company Limited is unable to accept returns of surplus or unwanted materials.

 

7.3 Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order.

 

8. Cancellation by Westminster Stone
8.1 We reserve the right to cancel the contract between us for any of the following reasons:

If we have insufficient stock to deliver the goods you have ordered.

If we are unable to deliver to your area

If upon investigation, access to your site is unsuitable for any of our contracted delivery vehicles
The goods that you ordered were listed at an incorrect price, either due to a typographical error, or error in the pricing information received by us from our suppliers.

 

8.2 If we do cancel your contract we will notify you by e-mail, and will where possible offer an alternative product on a new contract. Ww will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for the disappointment or inconvenience suffered.

 

9. Account Registration
To register with westminsterstone.com you must be over eighteen years of age.

 

You must ensure that the details provided by you on registration or at any time are correct and complete.

 

You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.

 

10. Password and security
When you register to use the westminsterstone.com website you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately.

 

If Westminster Stone has reason to believe that there is likely to be a breach of security or misuse of the website, we may require you to change your password or we may suspend your account in accordance with paragraph 16 below. Please ensure that your account registration details are correctly provided and complete. Inform us immediately of any changes required to the registered information by accessing your account to update the information you provided us. Westminster Stone Company Limited reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

 

11. Liability
11.1 If the goods we deliver are not what you ordered or are damaged or defective, or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 3 working days of the delivery of the goods in question. Where possible, goods should be checked on delivery, and the delivery note marked accordingly.

 

11.2 If you do not receive correct goods ordered by you within 30 days of the date on which you ordered them, We will not be obliged to offer any additional compensation for the disappointment or inconvenience suffered. However, If you notify a problem to us under this condition, our only obligation will be at our option:

 

  • 11.2.1 to make good any shortage or non-delivery;
  • 11.2.2 to replace or repair any goods that are damaged or defective; or
  • 11.2.3 to refund to you the amount paid by you for the incorrect goods in question in whatever way we choose.

 


11.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 11.2.3 above.

 

11.4 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable UK law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 

12. Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at Westminster Stone Company Limited, Shaws Estate, Sodylt, Nr Ellesmere, Shropshire, SY12 9EL, United Kingdom and all notices from us to you will be displayed on our website from to time.

 

13. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, vehicle breakdowns, breakdown of systems or network access, flood, fire, explosion, accident or war.

 

14. Limitations
You may not use the westminsterstone.com website for any of the following purposes:

  • transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
  • gaining unauthorised access to other computer systems
  • interfering with any other person's use or enjoyment of the simplypaving.com site
  • breaching any laws concerning the use of public telecommunications networks
  • interfering or disrupting networks or web sites connected to the simplypaving.com site
  • making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
  • disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material

 


Westminster Stone Company Limited and westminsterstone.com reserves the right to refuse to post material on the site or to remove material already posted on the site at its own discretion, and without the need for justification.

 

You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:

  • any claim by any third party that the use of the simplypaving.com site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
  • any claim by any third party that the use of the simplypaving.com site by you infringes that third party's copyright or other intellectual property rights of whatever nature; and
  • any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the simplypaving.com site by you.

 


15. Availability of the Westminster Stone website
Although westminsterstone.com aims to offer you the best service possible, Westminster Stone makes no promise that the services of the site will meet your expectations or requirements. Westminster Stone cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to email at ask@westminsterstone.com and we will attempt to correct the fault as soon as we reasonably can.
Your access to the website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Westminster Stone will aim to restore the service to you as soon as it is reasonably possible and practical.

 

16. Westminster Stone’s right to suspend or cancel your registration
Westminster Stone may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the site immediately.

 

The suspension or cancellation of your registration and your right to use the westminsterstone.com website site shall not affect either party's rights or liabilities.

 

Paragraphs 13 and 17 of these Terms and Conditions shall survive cancellation.

 

17. Westminster Stone's liability
The westminsterstone.com website is provided by Westminster Stone Company Limited without any warranties or guarantees. You must bear the risks associated with the use of the Internet.

Westminster Stone will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the. If Westminster Stone is informed of any inaccuracies in the material on the site we will attempt to correct the inaccuracies as soon as we reasonably can.

 

In particular, we disclaim all liabilities in connection with the following:

 

  • incompatibility of the westminsterstone.com website with any of your equipment, software or telecommunications links
  • technical problems including errors or interruptions of the westminsterstone.com website
  • unsuitability, unreliability or inaccuracy of the westminsterstone.com website

To the full extent allowed by applicable law, you agree that we will not be liable to you, or to any third party, for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Westminster Stone website.
Nothing in these Terms and Conditions shall exclude Westminster Stone's liability for personal injury or death caused by its negligence.

 

18. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

19. Rights of Third parties
Except for our directors, employees, affiliaites, associates or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

 

20. Intellectual Property Rights
The content of the westminsterstone.com website is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the westminsterstone.com website without the specific written permission from a Director of Westminster Stone Company Limited.
No licence is granted to you in these Terms and Conditions to use any trade mark of Westminster Stone Company Limited, or its affiliated companies including, without limitation, the trade marks Westminster Stone, westminsterstone.com, westminsterstone.co.uk, pavingandflooring.com, pavingandflooring.co.uk, landscapesupplies.co.uk, and all of the aforementioned preceded by the initials www.

 

21. Governing law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

 

22. Entire agreement
These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by Westminster Stone Company Limited. Nothing said by any sales person on behalf of Westminster Stone should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Westminster Stone. Save for fraud or fraudulent misrepresentation, Westminster Stone shall have no liability for any such representation being untrue or misleading.

 

23. Miscellaneous
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. If you breach these Terms and Conditions and Westminster Stone ignores this, Westminster Stone will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. Westminster Stone shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control. A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

 

24. Domain Names and Trading Names
Westminster Stone, westminsterstone.com, westminsterstone.co.uk, pavingandflooring.com, pavingandflooring.co.uk, and landscapesupplies.co.uk are all domain and trade names registered to Westminster Stone Company Limited, Shaws Estate, Sodylt, Ellesmere, Shropshire, SY12 9EL, United Kingdom.  All Terms and Conditions stated herewith apply to any and all of the above, and to domain names preceded by the initials www, however and whenever referred to within these Terms and Conditions.
